Popular Actress Wins Lawsuit Against Clinic After Sustaining 2nd Degree Burns During Skin Treatment Procedure

An actress who suffered burns from a dermatology procedure has won part of a damages lawsuit against the doctor responsible.

According to various media reports, the Seoul Central District Court’s 18th Civil Division ruled in favor of actress A in a lawsuit against dermatologist B from a clinic in Seocho-gu, Seoul. A had demanded 200 million won [$136,276] in damages, but the court ruled that B must compensate her with 48,039,295 won [around $32,733].

In 2021, A underwent three wrinkle-reduction procedures, including ultrasound and laser treatments, under sedation. However, during the procedure, she sustained second-degree burns on her left cheek. B reportedly only applied a moist bandage without taking additional measures.

Since 2021, A has undergone 50 treatments at different hospitals and dermatology clinics for burn care and scar reconstruction, spending over 10 million won [nearly $7000] in medical expenses.

The incident also disrupted her drama filming. She appeared in a weekend drama shortly after the procedure and had to spend 9.55 million won on computer graphics (CG) to conceal her scars.

During the trial, A argued that B should pay 200 million won in damages, claiming that B had been negligent by performing the three procedures consecutively without following safety protocols or adjusting the medical device settings. She suggested that the burn’s shape indicated excessive intensity or repeated treatment on the same area.

The court partially accepted A’s claims, ruling that B did not properly adjust the treatment settings based on A’s reactions to heat or pain before sedation. The court also noted that when performing multiple procedures at once, the patient’s skin condition and body type should be carefully assessed. Since no evidence showed that B had taken such precautions, relying solely on experience constituted negligence.

However, the compensation amount was reduced to 48 million won, covering 11.16 million won for past treatment costs, 1.1 million won for future treatment expenses, and 25 million won for pain and suffering.

Neither party appealed, making the ruling final.

Meanwhile, A has appeared as a lead or supporting actress in dramas such as “A Gentleman’s Dignity” and “Discovery of Love.” She is currently active on a variety show.
